Summary of Constitution

  1. The organization is referred to as the Mi'kmaw Kina'masuti (Mi'kmaq Education). The Constitution remains in draft form. The final form of the Constitution will be attached to the Final Agreement.

  3. The members of the organization are the 13 First Nations in Nova Scotia. The Board of Directors consists of the Chiefs of the First Nations who are members of the organization.

    • A Chief may be represented by an alternate if he is unable to attend the Board of Directors meeting.

    • The Board of Directors may elect an Executive Committee who will be the Chair, Vice-Chair, Secretary and Treasurer. These members are elected from the Chiefs whose bands are members. They hold office for one year and may be elected for further terms of one year each.

    • An alternate may not attend an Executive Committee meeting on behalf of an Executive member.

    • The Directors, on two-thirds majority may remove any executive officer from his or her office at any time.

    • The office of a Director is automatically vacated and the individual holding office is replaced by the new Chief or that First Nation if he dies or has ceased to be Chief.

  5. The Constitution states that the jurisdiction to be exercised with respect to Mi'kmaq education is exercised by the individual First Nation. This jurisdiction includes the jurisdiction to pass laws and regulations with respect to that First Nation.

The Constitution of the organization cannot be amended unless there are 75 percent of the members, representing at least 51 percent of the registered Mi'kmaq population of bands which are members of the organization, voting in favour of the amendment. The Constitution can be amended only if notice of the amendment is provided to the directors by regular mail or other method at least 30 days before the meeting. There is a special provision which states that the section of the Constitution which provides the jurisdiction is to be exercised by individual First Nations and not by the central organization cannot be amended without the unanimous consent of the members.
